1. Scope & Acceptance

This agreement applies to authorized organizational users — licensed healthcare facilities, providers, and their designated administrators. By accessing the Recovery Network Platform, you agree to these Terms. Recovery Network operates as a Business Associate to your facility under an executed BAA. Patient-facing terms are governed by the separate Patient Consent document presented at enrollment.

2. Nature of Platform

Recovery Network provides a secure, HIPAA-compliant clinical decision-support platform. The platform ingests, processes, and routes clinical signals through an AI Council of six specialized models, surfacing actionable risk intelligence across seven clinical portals. Your engineering team writes no integration code — deployment is measured in hours, not months.

3. AI Use & PHI Processing

The platform processes Protected Health Information (PHI) including wearable biometric signals and natural language processing (NLP) of patient communications, journal entries, and chat interactions, scored against C-SSRS and DAST-10 clinical frameworks. AI analysis generates risk tiers (Critical / High / Moderate / Low), alerts, and care recommendations.

4. Interpretive Support Only (The Human Wall)

Not Medical Advice

The Platform and its AI Council provide administrative and decision-support signals only. They do not provide medical diagnoses, clinical prescriptions, or autonomous treatment plans.

Human-in-the-Loop (HITL) Requirement

No high-stakes clinical or strategic action may be taken based solely on an AI output. Final authority and legal responsibility for any action taken reside exclusively with the named human user who authorizes the decision. Critical-tier alerts require licensed clinician review before any clinical action is taken.

5. Compliance Responsibilities

  • RNI is responsible for: PHI security, encryption, audit logging, and BAA obligations
  • Your facility is responsible for: obtaining appropriate patient consent for wearable data collection, NLP analysis, and AI-generated risk scoring prior to platform activation
  • 42 CFR Part 2 SUD record protections apply — disclosure requires explicit patient consent

6. Transparency & Audit Rights

  • Full audit trails available upon request for any AI-assisted signal or clinical output
  • PHI boundary crossing points documented and available for security team inspection prior to go-live
  • The AI Council is audited for bias prevention, including prohibition of zip codes as proxies for protected classes

7. Zero-Hallucination & Data Integrity

We maintain a Zero-Hallucination standard for internal data provenance. You acknowledge that AI-generated synthesis is probabilistic. We provide Transparent Intelligence — you can see which Doctor Lens influenced any output to apply your own human judgment.

8. Limitation of Liability

To the maximum extent permitted by law, Recovery Network's liability is limited to the technical performance of the platform. We are not liable for indirect, incidental, or consequential damages arising from AI-assisted signals. Final authority and legal responsibility for clinical actions reside exclusively with the licensed professional who authorizes the decision.

9. Prohibited Use

  • No use of the platform to generate data for training external AI models
  • No reverse-engineering of AI Council logic, consensus mechanisms, or scoring algorithms
  • No unauthorized redisclosure of 42 CFR Part 2 SUD records
